Ken Joseph Discusses SEC and DOJ Investigation into Nikola with Law360

Ken Joseph, Managing Director and Global Head of the Disputes Consulting practice, discusses short-seller allegations that Nikola exaggerated its ability to develop hydrogen-electric trucks and passed off third-party products as its own in a recent Law360 article. According to reports, as a result of the allegations, the U.S. Securities and Exchange Commission and the U.S. Department of Justice are investigating the company.

Discussing the claims, Ken said, "This is a complex multifaceted fact pattern that's likely to have ramifications not only at Nikola, but also at GM and the short-seller. Those [investigations] will center around the accuracy of any material statements that have been made, around the trading by insiders and by others, and around the governance and controls."
